Terms of Service

These terms are an agreement between you and Zentient AI, LLC ("we", "us") for using Coldspark's website, web app and iPhone app. By creating an account or using Coldspark, you agree to them and to our Privacy Policy. If you don't agree, don't use Coldspark.

1. Who can use Coldspark

You must be at least 18. If you use Coldspark for a company, you confirm you can agree to these terms for it, and "you" includes the company.

2. Your account

Give accurate information, keep your password safe, and tell us if you think someone else has used your account. You're responsible for what happens on it. Accounts are for one person; don't share them.

3. What Coldspark is

Coldspark is cold call practice. The prospects are fictional characters played by AI. Coldspark never calls real people or phone numbers.

Personas, their replies, memories and scorecards are generated by AI and can be wrong, inconsistent or unrealistic. Scorecards are coaching suggestions, not guarantees of results. Nothing in Coldspark is legal, compliance or professional advice; you're responsible for how you prospect and sell, including following the laws that apply to real calls.

4. Acceptable use

Don't use Coldspark to:

  • Create personas of real private people, or impersonate real people or companies in a misleading way.
  • Create or publish hateful, harassing, sexual, violent or illegal content.
  • Try to make personas produce harmful content, or get around Coldspark's safety measures or plan limits.
  • Upload or link content you don't have the rights to, such as avatar images.
  • Scrape, copy, resell or reverse engineer the service, or overload or disrupt it.
  • Break the law or anyone else's rights.

There's no tolerance for objectionable content or abusive users. We can remove content and suspend or close accounts that break these rules.

5. Your content

You own what you put into Coldspark: your seller profile, the personas you write and what you say on calls. You give us permission to store, process and display it, and to send it to our AI and voice providers, as needed to run Coldspark for you, as described in the Privacy Policy.

6. Community personas

When you publish a persona to the community library, you give every Coldspark user permission to view it, call it, and clone and change their own copy, inside Coldspark. Copies others made stay theirs after you unpublish yours or delete your account. Published personas are reviewed and can be removed at any time. To report a community persona, tap Report or block on it in the app, or email coldspark@zentient.ai with its name. A reported persona disappears from your feed, and we review every report. You can also block a creator to hide all their personas from you.

7. Plans, subscriptions and payment

Coldspark has a Free plan and paid plans; current prices and limits are on our pricing page. Practice minutes reset each billing period and don't carry over.

  • Automatic renewal: monthly and yearly plans renew automatically at the price shown until you cancel. Canceling stops the next renewal; you keep access until the end of the period you paid for.
  • Bought in the iPhone app: Apple bills you. Cancel at least 24 hours before the renewal date in your Apple ID settings (Settings → your name → Subscriptions). Refunds are handled by Apple under its policies.
  • Bought on the web: payments are processed by RevenueCat and Stripe. Cancel any time in the web app under Settings → Billing → Manage subscription. For refund requests, email us.
  • Teams: team plans are sold in seat packs. The team owner is responsible for the subscription. Seats cap how many people can be on the team, and members share the team's pooled minutes.
  • Price changes apply from your next renewal, after notice and any consent the App Store requires.

Deleting your account or the app doesn't cancel a subscription. Nothing in these terms limits a refund or cancellation right you have under the law where you live.

8. Teams

Team owners and admins can invite and remove members, assign practice, and see the calls members make on the team plan, including transcripts, scorecards and recordings. If you join a team, you agree its owners and admins can see that. If you run a team, you're responsible for the people you invite and for telling them how Coldspark is used.

9. Our property

Coldspark, its software, design, starter personas and brand belong to Zentient AI, LLC or our licensors. We give you a personal, non-transferable right to use Coldspark under these terms. If you send us feedback, we can use it without owing you anything.

10. The iPhone app

The iPhone app is also licensed to you under Apple's Standard Licensed Application End User License Agreement. These terms are between you and us, not Apple. Apple isn't responsible for the app, its support or any claims about it.

11. Ending your use

You can stop using Coldspark and delete your account at any time. We can suspend or end your access if you break these terms or if we need to for legal or security reasons. If we stop offering Coldspark, we'll give reasonable notice. Sections that by their nature should continue, such as 5, 6, 9, 12, 13 and 14, continue after your account ends.

12. Disclaimers

Coldspark is provided "as is" and "as available". To the fullest extent the law allows, we don't promise it will be uninterrupted, error-free, accurate or right for your needs, or that it will improve your results.

13. Limit of liability

To the fullest extent the law allows, Zentient AI, LLC isn't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and $100. Nothing here limits liability the law doesn't allow to be limited, or your rights as a consumer where you live.

14. Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law rules. This doesn't take away mandatory consumer protections you have under the law of the country where you live.

15. Changes

We may update these terms. We'll change the date at the top and, for material changes, tell you in the app or by email before they take effect. If you keep using Coldspark after that, you accept the new terms.
